What is a divorce appraisal, and what does it establish for a North Hollywood property?

A divorce appraisal establishes an independent opinion of the fair market value of the property as of a specific effective date, developed for use in dividing the community estate.

It is a legal finding, not something an appraiser determines — we work from the date your attorney or the court supplies.

When would a court use a valuation date other than the trial date?

When there is good cause, and the practical test often turns on what caused the value to change.

Where an asset’s value changed largely through one spouse’s personal effort after separation, courts more readily use a date at or near separation. Where the change came from market forces rather than either party’s work, the trial date generally governs. A house in a rising or falling market usually falls into the second category. Your attorney decides whether to seek an alternate date.

Can the house be appraised as of a date in the past?

Yes. That is a retrospective appraisal, developed with an effective date in the past, and it can be completed months or years after that date.

The appraiser analyses sales and market conditions as they existed on the effective date and documents the property’s condition as of that date using available evidence — permits, listing history, prior photographs, public records, and information from the parties. Longer gaps mean more reliance on documentary evidence, which is worth discussing at the outset.

Do we need one appraiser or two?

Either is possible. Many matters use a single appraiser retained jointly by both parties or through their attorneys.

A jointly retained neutral is generally faster and less expensive than two competing reports. Each party may instead retain their own appraiser, which is common where values are contested. A single independent appraisal does not prevent either side from challenging it — what it does is put one documented, methodology-transparent analysis in front of both.

What is a court-appointed expert, and how is that different from hiring an appraiser ourselves?

A court-appointed expert is appointed by the judge rather than engaged by the parties.

California Evidence Code section 730 allows the court, on its own motion or a party’s motion, to appoint one or more experts to investigate, render a report as ordered, and testify. The court may also set the expert’s compensation. That is procedurally different from a jointly retained neutral appraiser, whom the parties engage directly. Your attorney will advise which route fits your matter.

One of us owned the home before the marriage. How is that handled?

The appreciation is generally apportioned between the separate and community estates, and the appraisal supplies the value figures that calculation depends on.

Under In re Marriage of Moore (1980) and In re Marriage of Marsden (1982), where community funds reduce principal on separately owned property, the community acquires a proportional interest including a share of appreciation — while appreciation occurring before the marriage remains separate. Separately, Family Code section 2640 provides for reimbursement of separate property contributions that can be traced, without interest or adjustment for inflation. That usually means we are asked for value at more than one date. The apportionment itself is a legal calculation your attorney performs.
